It takes a lot to be a Lexpert Rising Star. Just ask the judges who had to weigh in on this year’s crop of candidates for Lexpert’s annual list celebrating leading lawyers under 40. With so many deserving lawyers nominated this year, picking a specific number was difficult.
“I was consistently impressed with the extremely accomplished candidates put before us,” says Sandra Abitan, managing partner with Osler, Hoskin & Harcourt LLP in Montreal. She was on the Lexpert advisory panel tasked with choosing from the many names submitted this year.
The Lexpert Rising Stars Awards, presented by Lexpert magazine and supported by Canadian Lawyer and InHouse magazines, were revealed at an in-person Gala at the Liberty Grand last November 22.
Advisory board member Leola Pon, GC and executive officer of legal services for the Toronto District School Board, says, “it was very exciting to see the large number of lawyers involved in equity and reconciliation work.” Those efforts should be recognized, he adds.
For advisory panel member Tom Curry at Lenczner Slaght, “first and foremost, I look at practice experience - whether it be cases or transactions, the work always stands out.” Curry adds that the client feedback in the nomination form was “very helpful to the process."
Fellow Rising Star judge Sue-Lynn Noel, senior vice president, general counsel and corporate secretary for Purolator in Toronto, says: “It’s not enough to be technically competent or even extraordinarily smart. Leadership qualities such as courage, emotional intelligence, inclusivity, and innovation are equally essential criteria.”
Abitan agrees, noting, “I was looking for those lawyers who have not only excelled in ensuring client success and serving as trusted advisers, but who also found time in their busy lives to contribute back to the legal profession and society more broadly.”
The advisory panel members also appreciated seeing increased diversity. Rising Stars judge Lucille D’Souza, vice president and associate general counsel of strategy and operations at the Royal Bank of Canada, says: “What struck me the most was the diversity of the candidates, representing all backgrounds and practicing in a wide range of legal disciplines.”
Abitan notes the legal world is “richer for having them,” especially as they shape the careers of the younger lawyers that they now mentor.

Consistent record of excellence
It goes without saying that a Lexpert Rising Star has a track record of “wins” that demonstrates the ability to take charge of complex cases.
For example, Christine Wadsworth at McCarthy Tétrault was part of a team that successfully defended TD Bank in McDonald and Dickson v. TD Bank, 2021 ONSC 3872. It involved a $5 billion claim stemming from a Ponzi scheme that fell apart during the 2008 financial crisis. Allan Stanford operated an $8-billion pyramid scheme through his Antigua-based bank, using a TD bank account. SIB’s liquidators sued TD, alleging negligence and knowing assistance in breach of duty. But the judge dismissed SIB’s claim and ruled TD did not have knowledge of Stanford’s breach of fiduciary duty and was neither reckless nor willfully blind. The case is important in setting out the scope of a bank’s obligations to a client who has been defrauded by an insider of the client.
Wadsworth played an integral role in preparing TD’s witnesses, cross-examining several opposing witnesses and crafting closing arguments, but she acknowledges that it “takes a team” to prepare for a complex trial – this one lasted 43 days – and come out with a successful decision for the client.
Advocacy through negotiation or dispute resolution
Iris Antonios, a partner at Blakes, Cassels & Graydon, has gained a reputation working on complex arbitrations and litigation. Examples of her success include being co-counsel to a Canadian in a confidential investor-state arbitration against a host government under a bilateral investment treaty and acting as co-counsel to a large consumer brands company in a successful confidential domestic contract dispute arbitration.
James Hemmings, senior counsel at Spectrum Brands, notes: “Called into a complex commercial dispute midstream, Iris gained such command of an array of facts that she quickly rose to be the most prominent voice on our outside legal team.”
For her part, Antonios says she likes “the idea of helping a client who is in a crisis or an uncomfortable situation, and you’re helping them through it - whether it’s through negotiation or a dispute resolution process - and you’re engaging your advocacy skills to do that.
Tackling public interest problems through class actions
Michael Rosenberg, another Rising Star at McCarthy Tétrault, has also had significant successes in the class actions, commercial disputes, and constitutional law cases he has worked. He led the McCarthy Tétrault team in prosecuting two class actions on behalf of a First Nations over the right to safe drinking water, winning an $8-billion settlement.
Another case he worked on dealt with the constitutionality of prolonged solitary confinement in federal prisons, with a judgement recognizing that these prisoners had been subject to cruel and unusual treatment. His defence work for Pretrium Resources, winning a dismissal of a case of shareholders alleging losses, also resulted in the first merits decision in a securities class action for secondary market misrepresentation.
“I love getting to solutions, and I particularly love tacking big public interest problems,” says Rosenberg. “It’s important work that allows me and the firm to participate in big conversations about the direction of the country.”
Making waves in intellectual property law
For Amrita V. Singh, one of the best things about being an IP litigator is the “translator” role she takes on, taking principles and facts that can be pretty complex “and making them more digestible” for the court. She also loves working with expert witnesses as they “tend to be among the best people in their field,” and she can benefit from their wisdom and experience.
“In a court room with lawyers and a judge who are well-educated and experienced, you still need to be able to translate the essence of the issues you want to get,” says Singh. “As an advocate, not only does it have to be digestible, but it also must be persuasive when it comes to explaining the nuances of your client’s position.”
Singh’s ability to make complex IP law easier to understand within the context of the arguments she is advocating has given her some significant wins. In 2020, she and colleague John Colombo won a decision for their client in the Federal Court of Appeal that preserved the Hilton hotel group’s rights to the famed Waldorf Astoria trademark in Canada — and in the process, denied a BC developer the use of the Waldorf name here. It’s a ruling that has helped settle the debate on the enforceability of a registered trademark, even if there is no physical presence in Canada.
“It’s an important case that moved the needle with respect to trademark law and e-commerce law,” says Singh, “and I was a full participant in the proceedings, which showed a lot of trust in me, and given the outcome, that the trust was well placed.”
Selena Lu, a Rising Stars winner from Quebec-based firm Lavery, also points to the importance of colleagues in helping her reach her potential.
“I would like to thank my colleagues for this heartwarming award, my clients for their trust and my family for their support,” she says. “This new milestone fuels my motivation to continue to strive for excellence and to invest in projects and ideas that shape the legal and business world. Along the way, I hope to help many people and companies rise and shine like stars.”
The future looks bright for the legal profession
D’Souza at RBC says that after reviewing the nominations, her impression “is that the legal profession is in good hands with this next generation of lawyers.” She adds she has every confidence that, with lawyers such as the winners and nominees for Lexpert’s Rising Stars, “the legal profession continues to be a strong contributor to the fabric of our society.”
Osler’s Abitan points out, “this is clearly a purpose-driven generation of lawyers who have achieved great success early in their careers,” not just academically and professionally, “but in terms of defining where they want to contribute back to society.”
Pon at the TDSB weighs in: “The candidates had outstanding achievements in their professional and personal lives. There are many opportunities for young lawyers to make their mark in our communities and in the legal profession, and these candidates demonstrated this.”
Purolator’s Noel says this year’s roster of Rising Stars gives her “every confidence in the future of the profession.” And Curry at Lenczner Slaght adds, “it’s been another inspiring year of judging,” and he continues to be impressed by the quality and quantity of submissions.
The importance of mentoring
The Rising Stars winners are also quick to point out the importance of mentoring to creating the great lawyers of the future. Fahad Siddiqui, a litigation partner with Norton Rose Fulbright says, the face of the Canadian bar is changing as we speak and it’s important that the next generation of legal leaders have all of the tools that they need to succeed. It is humbling to see how much time and energy our firm’s leadership invests in young lawyers and to be able to contribute to my up-and-coming colleagues.”
He adds that although the Rising Stars award recognizes individual achievement, “it is also a reflection of the continuing trust of my clients, firm chairs, and colleagues for which I am grateful. I look forward to continuing to have the opportunity to do fascinating work and to give back to the community in increasingly meaningful ways.”
In memoriam Jean Cumming

Voting commenced in August 2022 and their judgment was impartial, balanced, incisive, and fair.

The Lexpert Rising Stars Awards honour leading lawyers under 40 from law firms, in-house departments and other practices. Members of the legal profession were invited to nominate lawyers qualified in Canada who have made outstanding contributions in their careers thus far.
All shortlisted submissions were forwarded to the advisory panel comprising esteemed leaders and experts within the legal profession. The panel assessed and voted for the selection of winners, considering the following areas of accomplishment:
• Deals, cases or files
• Community involvement
• Contribution to the legal profession& professional development
• Contribution to organizational success
• Client service strategy
• Legal profession awards/accolades
The scores of the judging panel were then tallied to determine the winners. Votes by judges from the same organization as a candidate were voided to prevent a conflict of interest.
The Lexpert Rising Stars Awards, presented by Lexpert magazine and supported by Canadian Lawyer and InHouse magazines, were revealed at an in-person gala held at the Liberty Grand on November 22, brought to you by Key Media.
Advisory board member Leola Pon, GC and executive officer of legal services for the Toronto District School Board, says, “it was very exciting to see the large number of lawyers involved in equity and reconciliation work.” Those efforts should be recognized, he adds.
For advisory panel member Tom Curry at Lenczner Slaght, “first and foremost, I look at practice experience - whether it be cases or transactions, the work always stands out.” Curry adds that the client feedback in the nomination form was “very helpful to the process."
Fellow Rising Star judge Sue-Lynn Noel, senior vice president, general counsel and corporate secretary for Purolator in Toronto, says: “It’s not enough to be technically competent or even extraordinarily smart. Leadership qualities such as courage, emotional intelligence, inclusivity, and innovation are equally essential criteria.”
Abitan agrees, noting, “I was looking for those lawyers who have not only excelled in ensuring client success and serving as trusted advisers, but who also found time in their busy lives to contribute back to the legal profession and society more broadly.”
The advisory panel members also appreciated seeing increased diversity. Rising Stars judge Lucille D’Souza, vice president and associate general counsel of strategy and operations at the Royal Bank of Canada, says: “What struck me the most was the diversity of the candidates, representing all backgrounds and practicing in a wide range of legal disciplines.”
Abitan notes the legal world is “richer for having them,” especially as they shape the careers of the younger lawyers that they now mentor.

Consistent record of excellence
It goes without saying that a Lexpert Rising Star has a track record of “wins” that demonstrates the ability to take charge of complex cases.
For example, Christine Wadsworth at McCarthy Tétrault was part of a team that successfully defended TD Bank in McDonald and Dickson v. TD Bank, 2021 ONSC 3872. It involved a $5 billion claim stemming from a Ponzi scheme that fell apart during the 2008 financial crisis. Allan Stanford operated an $8-billion pyramid scheme through his Antigua-based bank, using a TD bank account. SIB’s liquidators sued TD, alleging negligence and knowing assistance in breach of duty. But the judge dismissed SIB’s claim and ruled TD did not have knowledge of Stanford’s breach of fiduciary duty and was neither reckless nor willfully blind. The case is important in setting out the scope of a bank’s obligations to a client who has been defrauded by an insider of the client.
Wadsworth played an integral role in preparing TD’s witnesses, cross-examining several opposing witnesses and crafting closing arguments, but she acknowledges that it “takes a team” to prepare for a complex trial – this one lasted 43 days – and come out with a successful decision for the client.
Advocacy through negotiation or dispute resolution
Iris Antonios, a partner at Blakes, Cassels & Graydon, has gained a reputation working on complex arbitrations and litigation. Examples of her success include being co-counsel to a Canadian in a confidential investor-state arbitration against a host government under a bilateral investment treaty and acting as co-counsel to a large consumer brands company in a successful confidential domestic contract dispute arbitration.
James Hemmings, senior counsel at Spectrum Brands, notes: “Called into a complex commercial dispute midstream, Iris gained such command of an array of facts that she quickly rose to be the most prominent voice on our outside legal team.”
For her part, Antonios says she likes “the idea of helping a client who is in a crisis or an uncomfortable situation, and you’re helping them through it - whether it’s through negotiation or a dispute resolution process - and you’re engaging your advocacy skills to do that.
Tackling public interest problems through class actions
Michael Rosenberg, another Rising Star at McCarthy Tétrault, has also had significant successes in the class actions, commercial disputes, and constitutional law cases he has worked. He led the McCarthy Tétrault team in prosecuting two class actions on behalf of a First Nations over the right to safe drinking water, winning an $8-billion settlement.
Another case he worked on dealt with the constitutionality of prolonged solitary confinement in federal prisons, with a judgement recognizing that these prisoners had been subject to cruel and unusual treatment. His defence work for Pretrium Resources, winning a dismissal of a case of shareholders alleging losses, also resulted in the first merits decision in a securities class action for secondary market misrepresentation.
“I love getting to solutions, and I particularly love tacking big public interest problems,” says Rosenberg. “It’s important work that allows me and the firm to participate in big conversations about the direction of the country.”
Making waves in intellectual property law
For Amrita V. Singh, one of the best things about being an IP litigator is the “translator” role she takes on, taking principles and facts that can be pretty complex “and making them more digestible” for the court. She also loves working with expert witnesses as they “tend to be among the best people in their field,” and she can benefit from their wisdom and experience.
“In a court room with lawyers and a judge who are well-educated and experienced, you still need to be able to translate the essence of the issues you want to get,” says Singh. “As an advocate, not only does it have to be digestible, but it also must be persuasive when it comes to explaining the nuances of your client’s position.”
Singh’s ability to make complex IP law easier to understand within the context of the arguments she is advocating has given her some significant wins. In 2020, she and colleague John Colombo won a decision for their client in the Federal Court of Appeal that preserved the Hilton hotel group’s rights to the famed Waldorf Astoria trademark in Canada — and in the process, denied a BC developer the use of the Waldorf name here. It’s a ruling that has helped settle the debate on the enforceability of a registered trademark, even if there is no physical presence in Canada.
“It’s an important case that moved the needle with respect to trademark law and e-commerce law,” says Singh, “and I was a full participant in the proceedings, which showed a lot of trust in me, and given the outcome, that the trust was well placed.”
Selena Lu, a Rising Stars winner from Quebec-based firm Lavery, also points to the importance of colleagues in helping her reach her potential.
“I would like to thank my colleagues for this heartwarming award, my clients for their trust and my family for their support,” she says. “This new milestone fuels my motivation to continue to strive for excellence and to invest in projects and ideas that shape the legal and business world. Along the way, I hope to help many people and companies rise and shine like stars.”
The future looks bright for the legal profession
D’Souza at RBC says that after reviewing the nominations, her impression “is that the legal profession is in good hands with this next generation of lawyers.” She adds she has every confidence that, with lawyers such as the winners and nominees for Lexpert’s Rising Stars, “the legal profession continues to be a strong contributor to the fabric of our society.”
Osler’s Abitan points out, “this is clearly a purpose-driven generation of lawyers who have achieved great success early in their careers,” not just academically and professionally, “but in terms of defining where they want to contribute back to society.”
Pon at the TDSB weighs in: “The candidates had outstanding achievements in their professional and personal lives. There are many opportunities for young lawyers to make their mark in our communities and in the legal profession, and these candidates demonstrated this.”
Purolator’s Noel says this year’s roster of Rising Stars gives her “every confidence in the future of the profession.” And Curry at Lenczner Slaght adds, “it’s been another inspiring year of judging,” and he continues to be impressed by the quality and quantity of submissions.
The importance of mentoring
The Rising Stars winners are also quick to point out the importance of mentoring to creating the great lawyers of the future. Fahad Siddiqui, a litigation partner with Norton Rose Fulbright says, the face of the Canadian bar is changing as we speak and it’s important that the next generation of legal leaders have all of the tools that they need to succeed. It is humbling to see how much time and energy our firm’s leadership invests in young lawyers and to be able to contribute to my up-and-coming colleagues.”
He adds that although the Rising Stars award recognizes individual achievement, “it is also a reflection of the continuing trust of my clients, firm chairs, and colleagues for which I am grateful. I look forward to continuing to have the opportunity to do fascinating work and to give back to the community in increasingly meaningful ways.”
It takes a lot to be a Lexpert Rising Star. Just ask the judges who had to weigh in on this year’s crop of candidates for Lexpert’s annual list celebrating leading lawyers under 40. With so many deserving lawyers nominated this year, picking a specific number was difficult.
“I was consistently impressed with the extremely accomplished candidates put before us,” says Sandra Abitan, managing partner with Osler, Hoskin & Harcourt LLP in Montreal. She was on the Lexpert advisory panel tasked with choosing from the many names submitted this year.

Using a simple points system to aggregate judges' votes, the excellence awardee with the top score in a category will be named the winner. Winners will be announced at the awards show on October 20, 2022 and on this website. They will also be promoted in Canadian Occupational Safety. The winners in each category will be announced at the Australian Education Awards official gala event and awards ceremony on Friday, 12 August 2022 at the Doltone House - Darling Island. Winners will also be published on The Educator's website.

Methodology
This award recognises an HR leader who has demonstrated excellence at the executive level over the past 12 months. Eligible finalists were senior-level leaders who report to the CEO and manage an HR team. Finalists were judged on their leadership, communication, strategy, drive and results.
